Four commissions of the Senate and Chamber of Deputies, reunited in a joint meeting, yesterday voted in favor of dismissing the president of the Financial Oversight Authority (ASF), Mişu Negriţoiu, in his absence.

The president of the European Commission of the Chamber of Deputies, PSD deputy Mihai Tudose, has announced the effective start of the dismissal procedure.

The proposal is set to be voted in a joint meeting of the two chambers of the Parliament, most likely next week, according to Tudose.

Mişu Negriţoiu did not attend the hearings and instead sent a letter to the MPs in which he stated that the dismissal of a Board of Directors of the ASF is not legally possible, as long as the member meets the requirements that have contributed to his appointment, according to News.ro.

The MPs were angered by the absence of the ASF chairman, who had already been heard a week ago, as well as in September, amid the row concerning the rise of the RCA tariffs.

"The letter sent by the president of the ASF, who missed the hearings, represents an act of war, in which he pits the ASF against the Romanian parliament", PNL deputy Andreea Paul told us.

He said: "It is not enough for the Romanian parliament to win this war. We are going to need to be ten times more careful, in the coming period, and pick a competent individual, who cares about Romania and Romanians. And this is not an appeal to emotion. It is one that concerns the effectiveness of the market oversight and regulation".

Andreea Paul also said that she had asked the Budget commission to disclose the collective employment contract, term duration and the compensation regulations of the ASF.

"The lies that they have resorted to in the public space is intolerable, even though they had the evidence on the table", said Mrs. Paul, referring to the fact that the ASF has repeatedly stated that the president of the ASF isn't paid severance indemnity, upon the expiration of their term.

After Andreea Paul published the collective employment contracts for 2015-2016 and 2016-2017, the ASF sent a statement that the new contract provides no severance indemnities, but without mentioning the previous contract, which still applies until November 5th. The ASF stipulated that the new contract has been approved by the Board of the ASF one day after the Andreea Paul had made it public.

According to Andreea Paul, the president of the Financial Oversight Authority (ASF), Mişu Negriţoiu, would be paid eight severance indemnities, i.e. 104,000 Euros, if he is dismissed from the institution, which is why is refusing to resign.

According to the deputy, article 55 of the collective employment contract of the institution stipulates the payment of 8 salaries in the event of the president's dismissal.

PNL deputy Daniel Zamfir thinks that the dismissal of Negriţoiu must not be postponed further.

"It is a mistake to postpone this man's dismissal any further. He doesn't want to leave? We are going to dismiss him", said Zamfir.

Transporters have been asking for his resignation for months, amid the row concerning the increase of the RCA tariffs. They have been joined by an increasing number of MPs. Aside from the 13,000 Euros salary, the ASF president is also being paid a pension.

In his wealth statement filed on June 1st, 2016, the president of the ASF mentions a pension of 52,137 lei.
