Between September 2009 and January 11th, 2010, the National Fiscal Agency (ANAF) has initiated 1537 spot-checks of individuals that concluded real estate transactions between 2006 and 2008. According to a press release by ANAF, over 1054 of these spot-checks have been completed.
Following these audits, 38 notifications were submitted to prosecutors, for damages worth 34.5 million lei. At the same time, ANAF decided the taking of precautionary measures against 154 taxpayers, for an amount of 238.12 million lei.
Given the large number of taxpayers that concluded real estate transactions in the 2006 - 2008 period and the limited manpower of ANAF, the taxpayers which were audited as part of the first batch of spontaneous audits were selected using several criteria (the exceeding of the minimum VAT exemption cap of 35,000 Euros, the amount of the transactions and the making of more than five transactions in a year).
ANAF is targeting 7,145 individuals which made 85,442 transactions, worth 14,886 million lei (approximately 3.5 billion Euros). According to ANAF, this includes operations for which VAT is due as well as which are subject to VAT exemption, with the distinction to be made by investigations in the field as well as at the headquarters of the competent fiscal authorities.
