The Romanian Court of Common Pleas set the hearing for January 27, for resuming the lawsuit filed by the Romania Mare Party (PRM) requesting the annulment of the Government Ordinance concerning the delimitation of the electoral colleges in the parliamentary elections of November 30th, lawsuit which was suspended following an exception raised by the PRM lawyer, Lucian Bolcaş.
The Romanian Constitutional Court (CCR) denied, on November 18th, the exception raised by PRM during the trial requesting the annulment of the government ordinance. CCR has ruled that the provisions of the ordinances challenged by PRM are constitutional.
PRM challenged the fact that the law has been amended by emergency ordinances, which were intended to give the Government an unfair advantage. Lucian Bolcaş claimed that the Government"s amendments to the law infringe on the basic election rights, in particular the equality of votes.
"The Parliament has decided that it is forbidden to discriminate based on the number of residents in uninominal colleges which hold more than 30%, but in turn the Government Ordinance ruled that this difference should usually be 30%, going over the Parliament"s interdiction, which represents a blatant infringement of the voting rights", claimed Bolcaş, as quoted by Agerpres.
The Government denied allegations that the two ordinances were issued in order to gain an electoral advantage.
