Public assets, sold illegally by liquidators

The liquidator, even though supposed to uphold the law and the Constitution, claims he was not aware the assets were the property of the state, mistakenly thinking that they were the property of the fruit farming research station

The mistake made by the liquidator still remains unsolved, two years later, due to the failure of ministries to communicate with each other

Several assets which are the property of the state, which were under the management of the Strejeşti research station, were unlawfully sold by the court appointed liquidator, during the liquidation proceedings.

The liquidator claims that he didn"t know the assets sold were the property of the state, as the assets were recorded in the books as being the property of the research station.

According to the Constitution, assets which are the property of the state can not be sold, only leased.

This case involves the Fruit Farming and Research Station of Strejeşti, in the county of Olt. The assets in question were appraised at over 700,000 lei.

The station went bankrupt two years ago, and the issue of the assets which are the property of the state and which were sold illegally, has not been solved to this day.

The assets in question are 11 buildings, which according to official documents, were encumbered during the bankruptcy proceedings and after the disbanding of the station, they were left unmanaged and with an uncertain legal status.

Following this affair, several of the properties were illegally occupied. Out of the assets which have been sold, the ground floors of the buildings were the most sought after. Some of them invested in their modernization, which now makes it difficult for the state to restore its right of ownership.

By way of a government decree, the Ministry of Agriculture tried to solve the problem, but to years later it is still left hanging two years later. The decision of the Government provides the transfer of the 11 buildings owned by the state under the administration of the Agency for the Administration of State Domains, a structure which also manages the plots of lands on which they are seated. According to our information, the document, which is care still present on the website of the Ministry, has remained stuck somewhere along in its circuit between the two ministries and has yet to be approved.

The state of the main assets which were sold

- The singles hostel is being occupied illegally. the ground floor of the research station has been sold.

- The building which contains the winemaking installation, the fruit storage area, and the distillery are free of any encumbrances, but have no access to the national road DN 64, as it is surrounded by other assets witch have already been sold.

- The ground floor of another bulding has also been sold. Its buyer also performed various renovations on the other buildings.
