Mihai Cristian Atănăsoaei, the Prefect of Bucharest, yesterday filed a lawsuit with the Administrative Court of the Court of Bucharest, requesting the invalidation of the building permit issued by the Mayoralty of District 1 for the building located at 19, Biserica Amzei St. The hearing in the case was set for April 30th, 2010, according to a press release sent to our editors. As a result, the building permit was invalidated by law, and the State Inspectorate for Constructions will investigate whether the construction work has begun.
The prefect brought this action after finding several illegalities. According to the quoted source, at the time the building permit was issued (December 2009), the Mayoralty of Bucharest was the only authority which was competent enough to issue building permits for buildings located in the safety area of a historical monument. In this particular case, the building located at 19, Biserica Amzei St., is located in the safety area of a historical monument, namely the headquarters of the French Embassy, meaning that the Mayoralty of District 1 did not have the competence to issue a building permit.
The Mayoralty of Bucharest expressly requested through an address sent in October 2009 to the Mayoralty of the 1st district, that the latter not issue a construction permit for the building in question, since the court issued a final ruling on the eviction of the tenant of the building located at 19, Biserica Amzei St.
