The Competition Council has given fines of 83.7 million RON (22.6 million EUR) to Eli Lilly Export SA - Switzerland, A&A Medical SRL, Relad Pharma SRL and Mediplus Exim SRL. This is the second major fine given by the Council after the 30 million EUR one given three years ago to Holcim, Carpatcement and Lafarge for having set up a price cartel. Carpatcement challenged the fine and won a refund in court.
The Council determined that producer Eli Lilly Export SA and distributors A&A Medical, Relad Pharma and Mediplus Exim had come to an unfair agreement. The Council fined Mediplus Exim with 49,231,049.79 RON, Relad Pharma with 26,312,060.59 RON and A&A Medical with 4,331,908.87 RON Eli Lilly got a 3,823,710.36 RON fine. The Council also determined that the Ministry of Health violated the Competition law by not having organized tenders for insulin in 2004 - 2006.
